"We adopt this strategy now because there's an urgency to this debate. Over time, the space of free expression has shrunk." –Lawrence Lessig

The IFPI study (2009)..
In this old press release from APRA/RIANZ they say "it is estimated that 19 out of every 20 downloaded songs infringe copyright." This statistic comes from a self-produced music industry study (released by the IFPI) saying that 95% of music downloads are illegal. The IFPI only 10% of these these to lost sales, and neither statistic in the IFPI study is backed by scientific rigor. Further, the study is internally inconsistant... see IFPI: Music piracy at 95%! (or is it 18%?) and Brenda Wallace's response. Illegal downloads occur, but we are yet to see the verified process through which these figures were reached.
