CNet reports that Jammie Thomas-Rasset will be appealing the 3M fine on constitutional grounds. "She wants to take the issue up on appeal on the constitutionality of the damages. That's one of the main arguments--that the damages are disproportionate to any actual harm". The fine has seen massive protest against the music industry, with artists such as Moby and Richard Marx (one of the artists whose copyright was infringed) denouncing the judgment.

Well I hope that Jammie Thomas-Rasset Wins this case because 3 Million dollars is just ridiculous.

What I would like to see from this case is the court requiring the accuser to produce proof of their "lose". Do they have proof of how many people actually downloaded from the share? Or even how many times the said music was downloaded from HER share.
They seem to be basing their damages entirely on unsubstantiated claims.

I'm guessing that the range of damages made (somewhat) more sense in a time when it was prohibitively expensive for individuals to distribute copies; when it would have been done by companies with deeper pockets.
